الملخص
اعتبر المشرع العراقی عقد الزواج باطلاً أن لم یتم الدخول وصحیحاً أن تم الدخول، فی حین اعتبره جمهور الفقهاء عقداً باطلاً تم الدخول أم لم یتم، واعتبره فقهاء الحنفیة عقداً صحیحاً لازماً وذهب بعض الفقهاء القدامى والمحدثین الى اعتباره عقداً موقوفاً على اجازة العاقد المکره بعد زوال الاکراه. وهو الرای الراجح حمایة لمصلحة العاقد المکره
