الملخص

المستخلص                             الوساطة  وسیلة ودیة من خلالها یساعد شخص محاید الأطراف فی التوصل إلى اتفاق مقبول للخلاف بینهم. تعد الوساطة الجنائیة اجراء جدیداً یهدف الى حل الخصومات الجنائیة البسیطة بطریقة ودیة اجتماعیة بعیداَ عن ساحات القضاء. فالوساطة الجنائیة هی نموذج للعدالة الإصلاحیة او التعویضیة تقوم على فکرة تعویض المجنی علیه وإصلاح الجانی، هدفها انهاء الخصومة الجنائیة قبل تحریک الدعوى الجزائیة. تتناول هذه الورقة الوساطة الجنائیة باعتبارها إحدى ممارسات العدالة التصالحیة والتعویضیة التی تقوم على فکرة تعویض الضحیة وإعادة تأهیل الجانی وقدرتها على إنهاء النزاع قبل بدء الدعوى الجزائیة.
