الرقابة المالیة المستقلة فی التشریع العراقی

الملخص
تعد الرقابة المالیة من أهم الوسائل لضبط المال العام المصادر والمنفق فی کل العصور فلها الدور الرئیس فی تنظیم المجتمعات ومؤسساته ، إذ ان أی نظام إداری أو مالی لا تتوفر فیه رقابة صحیحة ومنظمة یعد نظاماً ناقصاً یفتقر إلى المقومات المتکاملة ، وتبعاً للفصل بین السلطات وجدت أنواعٌ مختلفة من الرقابة کالرقابة الإداریة والبرلمانیة والقضائیة ورقابة الهیئة المستقلة وهو مدار بحثنا ، وتمارس هذه الرقابة أجهزة مستقلة ومتخصصة تقوم بمهمة الرقابة المرکزیة على نشاط الأجهزة الحکومیة ، وقد أخذ التشریع العراقی بهذه الرقابة متمثلاً بدیوان الرقابة المالیة بموجب القانون رقم 6 لسنة 1990المعدل ، إلى جانب هیئة النزاهة العراقیة التی تم إنشاؤها بموجب الأمر الصادر من سلطة الاحتلال رقم 55 لسنة 2004 الخاص بقانون النزاهة
