أضواء على قانون تنظيم استخدام النقد في بعض المعاملات في قطر -دراسة تحليلية-

الملخص

يتناول البحث موضوع حظر استخدام الدفع النقدي في بعض المعاملات المالية التي تتجاوز قيمتها خمسين ألف ريال واستبداله بوسائل دفع بديلة في ظل القانون القطري، ونظراً لحداثة تعامل المشرع مع هذا الموضوع فقد اعترى القانون بعض الثغرات والغموض؛ لذلك يهدف هذا البحث إلى تقديم دراسة نقدية لهذا القانون وفق منهجية وصفية وتحليلية. وتم تقسيم البحث إلى مبحثين تناول الأول دراسة قواعد الحظر النقدي وبيان المعاملات التي تخضع لهذا الحظر، وتناول المبحث الثاني تحليلاً لوسائل الدفع البديلة. ومن النتائج والتوصيات التي خلص اليها البحث أن المشرع لم يكن موفقاً في حصر حظر استخدام النقد في معاملات معينة دون غيرها بالرغم من أن مسوغات الحظر لا تنحصر في معاملات معينة، وكذلك اعترى الغموض بعض المعاملات التي اخضعها المشرع للحظر، وأوصى البحث بتعديل القانون ليشمل الحظر المعاملات كافة دون تحديد وألا يتم تقييد بدائل النقد بتلك المرتبطة بالمصرف في حال كانت معتمدة من قبل المصرف المركزي ومتداولة بشكل مشروع في الدولة.
