التحکیم التجاری الدولی فی القانون العراقی

الملخص
لا شک بأن التحکیم التجاری یعد من اقدم الوسائل التی لجأ الیها الانسان بغیة فض نزاعات التحکیم ، لما توفره تلک الآلیة من سرعة الانجاز واقتصار الوقت ، مما اسهم بتبدید مخاوف المستثمرین، ونظرا لتوسع التجارة الدولیة لجأت العدید من الدول لإصدار قوانین حدیثة مستمدة من القانون النموذجی للتحکیم التجاری الدولی ، الا ان القانون العراقی لم ینظم احکام التحکیم التجاری الدولی سوى فی قانون المرافعات المدنیة رقم 83 لسنة 1969 فی المواد (251-276)، وهو ما جعل من التحکیم التجاری الدولی فی العراق شبه معطل، وهنا تکمن الحاجة لتشریع قانون التحکیم التجاری العراقی بصورة تتماشى مع التطورات الدولیة التی طرأت على التجارة الدولیة ، ناهیک عن ضرورة انضمام العراق الى الاتفاقیات الدولیة فی هذا المجال و منها اتفاقیة نیویورک لعام 1958.
