آثار التنفیذ المباشر للقرار الإداری

الملخص
المستخلص تتمتع السلطة الاداریة فی مجال القانون العام بعدة امتیازات ومنها التنفیذ المباشر للقرار الإداری القائم على تنفیذ الادارة المباشر لقراراتها المشروعة ومن دون اللجوء إلى القضاء للحصول على حکم بذلک وأن لجوء الادارة للتنفیذ المباشر یرتب علیه الآثار القانونیة وذلک من خلال احداث تغییر أو تعدیل فی المراکز القانونیة القائمة وقت التنفیذ خاصة أنه یعتبر عملاً انفرادیاً من جانب الادارة مما یقتضی معه ربطه بالغایة التی تسعى الى تحقیقها السلطة الاداریة. وبالهدف الذی منحت من أجله التنفیذ المباشر وکذلک الالتزام بالقیود والاجراءات الواجبة علیها الالتزام بها سواء عند اتخاذ القرار الخاضع للتنفیذ المباشر أو عند اتباعها الاجراءات اللازمة فی التنفیذ المباشر للقرار الذی اتخذته الادارة مسبقاً، إذ أنه یعد حق الادارة فی التنفیذ المباشر للقرار الإداری استثناءً على القاعدة العامة والتی یکون بمقتضاها بالنسبة للإدارة والأفراد على السواء ضرورة الالتجاء إلى القضاء فی حالة المنازعة، خاصة أن العملیة الاداریة تسعى دائماً إلى تحقیق الصالح العام للمجتمع وأن القرارات التی تتخذها الادارة تسعى إلى تحقیق هدف معین وأن الإدارة بالتنفیذ المباشر تتفادى بذلک الهدف ما قد یحدث للمجتمع من اضرار کون أنه امتیاز معزز للإدارة وذلک لأنه نابع من فکرة السلطة التی تتمیز بها الادارة عن الافراد. وبالتالی فإن خروج الادارة عن تلک الحدود یؤدی بها إلى تحقیق مسؤولیتها القانونیة ویصبح عملها غیر مشروع وهذا بدوره یؤدی إلى ترتیب آثار تعمل على تهدید مصالح الأفراد والذی ینتج عنه زعزعة للثقة ما بین الادارة والافراد.
