الطعن بقرارات جهات التوثیق -دراسة مقارنة-

الملخص
قد تجانب قرارات جهات التوثیق الصواب عند مباشرتها لمهامها، بسبب الخطأ فی تطبیق القواعد القانونیة التی اوجب المشرع على جهات التوثیق مراعاتها للحفاظ على حقوق الافراد من الضیاع، الامر الذی یشکل خروجا على مبدأ المشروعیة وسبباً للطعن بقراراتها، الا ان النصوص التی عالجت مسألة الطعن بقرارات جهات التوثیق لم تتسم بالوضوح والدقة، فنجد ان المشرع العراقی قد نص فی قانون الکتاب العدول على تشکیل هیئة لدراسة المعاملات التی تحال الیها من قبل المدیر العام تسمى الهیئة الاستشاریة لذا فهل تعد القرارات الصادرة عنها ملزمة ام من قبیل التوصیة؟ کما ان الطعن بقرارات الکتاب العدول یکون امام المحکمة الاداریة الامر الذی یؤدی الى عزوف الکثیر من الاشخاص عن الطعن بقرارات الکتاب العدول بسبب البعد، کما ان المشرع العراقی اجاز الطعن ببعض قرارات جهة التصدیق دون الاخرى بدون سبب یدعو الى هذا التمییز، لذا فقد قدمنا مجموعة توصیات للمشرع العراقی لعلاج هذه الاشکالیات.
