التنفیذ الجبری العکسی – دراسة مقارنة

الملخص
یعد التنفیذ العکسی فی الأحکام القضائیة المدنیة، نوعاً من أنواع التنفیذ الجبری الذی یباشره المدین (سابقاًُ) الذی أصبح محکوم له بعد صدور حکم الإلغاء لمصلحته من محکمة الطعن المختصة، ضد الدائن (سابقاً) الذی أمسى المحکوم علیه بعد ذلک الحکم. مما یترتب على ذلک إلغاء الإجراءات التنفیذیة السابقة وإعادة الحالة للطرفین إلى ما کانت علیه قبل التنفیذ الأصلی ومطالبة (المحکوم علیه) بعد الإلغاء، أی الدائن (سابقاً) برد ما قبضه من المدین (سابقاً) أی الدائن بعد الإلغاء تبعاً لذلک الحکم.
