دور القضاء الدولي في تطوير القانون الدولي للبحار
الملخص
يناقش البحث دور القضاء الدولي في تطوير القانون الدولي للبحار، كأحد المصادر الرئيسة التي ساهمت في تطوير مبادئ وقواعد هذا القانون، بهدف تنظيم استخدام البحار من قبل الدول، والتصدي لحلّ المنازعات التي نشأت بينها والمعروضة على هيئاته. وتمثّلت مشكلة البحث في بيان مدى تمكن القضاء الدولي من استحداث مبادئ وقواعد منظمة عبر تصدّيه للمنازعات البحرية المعروضة عليه؟ وقد استخدمت الباحثة أكثر من منهج في البحث، وذلك من خلال تقسيمه إلى مقدمة، ومبحثين، وخاتمة تضمنت النتائج والتوصيات. إذ تناول المبحث الأول التعريف بالقضاء الدولي وهيئاته المتمثلة بمحكمة التحكيم الدائمة ومحكمة العدل الدولية والمحكمة الجنائية الدولية والمحكمة الدولية لقانون البحار. والتعريف بالقانون الدولي للبحار ونشأته وتطوره حتى توجته اتفاقية الأمم المتحدة لقانون البحار 1982. بينما تناول المبحث الثاني دور القضاء الدولي في تطور القانون الدولي للبحار التطور عبر التركيز على دور كل من محكمة العدل الدولية والمحكمة الدولية لقانون البحار في تطوير القانون الدولي للبحار.
