The effectiveness of family protection: A comparative study of Islamic law and international law
Abstract
International human rights treaties and covenant recognize the rights related to family life and family unity. The universal declaration of human rights defines the family as the natural and fundamental group unit of society confirming that family is entitled for protection by society and state . However, it can be argued that cultural identities and differences of some societies or nations have been neglected in these international instruments. Thus, the study investigates the protection provided to the family in international law comparing to Sharia law. the aim of the study is to examine the extent to which they are compatible with each other and thereby the effectiveness of international law in this context.
