الملخص
أثار موضوع دعوى المنافسة غیر المشروعة التی تمکن المتنافسین الذین تعرضوا لأعمال منافسة غیر مشروعة من الحصول على وسیلة للحفاظ على مراکزهم وسمعتهم التنافسیة الاهتمام على مستوى الصعید الدولی التی لم تنل الا قدرا قلیلا فی مجال التنظیم القانونی فی ظل القوانین الداخلیة ومنها القانون العراقی الذی لا یتناسب مع أهمیتها فی مجال حمایة الحقوق التی تخص ما هو حدیث من العلوم والتکنولوجیا وما الى ذلک من اثر فی نطاق القانون الدولی الخاص خاصة فیما یتعلق باختلاف الحکم فی مسألة تحدید القانون الواجب التطبیق والمحکمة المختصة بنظر المنازعات المتعلقة بمثل هذه الدعوى ولما من طبیعتها الخاصة الأثر فی تحدید ذلک فضلا عما ما جاءت به الاتفاقیات الدولیة التی عالجت مثل هذه المسألة ولاسیما اتفاقیة تربس
