تجاوز حدود الحق فی الدفاع الشرعی فی إطار القانون الدولی

الملخص

منح میثاق الامم المتحدة الصادر عام 1945 وعلى وجه التحدید فی نص المادة(51) الحق للدول فی رد العدوان  دِفاعا عن النفس؛ لابل قَد أُعتبر هذ الحق بأنه حق طبیعی لا یجوز حرمان الدولة التی تتعرض للعدوان منه او حتى الانتقاص منه، وهذا الحق یمکن ان تتخذه الدولة للدفاع عن نفسها بمفردها او تتخذه مجموعة من الدول یجمعها هدف معین وهذا ما یسمى بالدفاع الشرعی الجماعی.واذا کان هذا الحق قد اعطی للدول الأعضاء فی المیثاق الدولی، فإن واضعی النص قد وضعوا قیدا للحد منه، وهو ان لا یکون هناک تعسف فی استعماله او التجاوز فی مداه لیلحق ضررا بالدولة الاخرى وشعبها، بل یجب ان یکون مبدأ التناسب والضرورة حاضرین بین فعل العدوان الحاصل على الدولة وبین الدفاع من اجل صد الاعتداء او الحد منه، على انه فیما لو تم التجاوز فان حق الدفاع الشرعی سینقلب الى عدوان صارخ تتحقق ازاءه مسؤولیة الدولة القائمة بالدفاع طبقا لقواعد المسؤولیة الدولیة بنوعیها المدنیة والجنائیة الفردیة.
