Abstract

Abstract The direct execution of administrative decisions is an important principle in the administrative law to ensure the functioning of public facilities . This power of direct execution of administrative decisions is defined as (the right of the administration to implement its decisions by itself forcibly without resorting to the judiciary). This privilege of direct implementation is not a goal in itself, it is a means for the administration to be able to carry out its duties. The research hypothesis is that when the administration enjoys the privilege of direct execution, it has its legitimate core. However, it is a dangerous privilege when it is misused by the administration. The aim of this research is to discuss the mechanisms followed by the administration to maintain the legitimacy of the direct execution of its decisions. if the administration misused the power granted would be legal responsible for its actions, and this could result in a destabilization of trust between the administration and individuals.
