تمییزعقد البیع الدولی للبضائع عن عقد المقاولة

الملخص
یعد عقد البیع الدولی للبضائع عصب التجارة الدولیة ومحورها، ومضمونه یفید نقل ملکیة شیء من احد المتعاقدین الى المتعاقد الاخر مقابل ثمن نقدی یدفعه الاخیر، فهذا المعنى واضح لا لا غموض بشأنه( )، ولکن الغموض فی تلک البیوع التی تجری کثیراً بین المتعاملین دولیاً ، والتی یصعب التمییز فیها بین عقد البیع الدولی للبضائع وعقد المقاولة الذی یخرج من نطاق تطبیق اتفاقیة فیینا 1980 خاصة عندما یتعلق البیع ببضاعة یتعهد البائع بصنعها او إنتاجها حیث یطلب فیها المشترون من البائعین تورید أشیاء مصنوعة بواسطة البائع وفقاً للمواصفات المطلوبة ولها مزایا خاصة وأوجه استعمال قد تتعدد أنواعها ، کل ذلک لکی تلبی او ترضی أذواق المستهلکین وحاجاتهم
